ЩОДО ЛЕГАЛІЗАЦІЇ КАНАБІСУ В МЕДИЧНИХ ЦІЛЯХ

On legalization of cannabis for medical purposes The article examines the issue of legalization of medical cannabis (cannabis) for medical purposes in Ukraine. The international legal acts to which Ukraine has joined in the fight against illicit trafficking in narcotic drugs and psychotropic substances are analyzed. National legislative acts regulating the production and circulation of narcotic drugs, psychotropic substances and precursors have been studied. The main aspects and arguments of the draft law of Ukraine «On Amendments to Certain Legislative Acts of Ukraine on Regulating the Circulation of Cannabis for Medical Purposes, Scientific and Scientific- Technical Activities» are identified. The generalized analysis of results of researches of separate international organizations and their conclusions concerning influence of addiction to the medicines made on the basis of medical hemp is given. The current norms of the Criminal Code of Ukraine in the field of banning the circulation of narcotic drugs, psychotropic substances and precursors are analyzed. Positions and arguments of supporters and opponents of legalization of medical cannabis in the context of criminal law are considered. The authors argue that at the present stage of development of regulations on the handling of substances that, according to international legal classification, belong to narcotic and psychotropic substances, the state of development and control mechanism by the state, there are a number of risks associated with the threat of hemp for use in the manufacture of narcotic substances for further construction, «under cover» of the process of growing cannabis for medical purposes. The author’s own position on the prospects of medical use of cannabinoids as analgesics and other drugs is presented, the main possible risks in the modern Ukrainian present, the peculiarities of the functioning of the system of state control over the pharmaceutical sphere are outlined. Emphasis is placed on the possible negative consequences for society in the event of the introduction of such an incomplete and conceptually unrealized mechanism for the legalization of medical cannabis in Ukraine.
