ТЕОРЕТИКО-ПРАВОВИЙ МЕХАНІЗМ ЗАХИСТУ ПРАВА НА ЖИТТЯ ПРАЦІВНИКА У СФЕРІ ПРАЦІ
Abstract
The relevance of the article is that life is not just existence, but the constant development of a man in the process of work as an individual, a member of society. That is why the mechanism of its protection must always be functioning, act in the process, and not only during or after the violation of these rights. Accordingly, the protection of the employee's right to life in the field of labor includes a system of means, methods not only to eliminate and terminate, but also to prevent various factors that may adversely affect the life and health of the employee in the course of work. It is substantiated that on the basis of theoretical and branch developments the elemental composition (structure) of the mechanism of realization of protection of the right to life of employees in the field of work is defined. It is emphasized that in the context of methods and means of protection, the form is an objective unifying factor. The application of one or another means, the method provided for at the regulatory level is possible in the framework of legal activities, because only in this case will be the implementation of their essential purpose in practice. It is
emphasized that the mechanism of protection of the right to life of employees in the field of labor is a complex and dynamic category of legal science, which is an integral part of the mechanism of legal
regulation and derives from it and is directly related to the mechanism of individual rights and freedoms. The functional characteristic of any legal category, or the phenomenon of legal reality, is impossible without an etymological definition, as well as an essential understanding of the definition, which denotes the phenomenon. This feature is well known in the scientific field and recommended for theoretical research of legal issues. This also applies to topics that are the subject of relevant research. It is noted that the mechanism of protection of the right to life of employees in the field of labor is a complex and dynamic category of legal science, so it is proposed to consider it in different aspects and distinguish within the following position: instrumental, normative, sociological and axiological approaches.
