Адвокатська мантія в контексті законодавчого регулювання професійних прав адвоката
Abstract
This article is devoted to the historical and legal analysis and legal use of symbol of the bar, namely – attorney’s robe. The research of legal
was held for the implementation of attorney’s robe and analyzes the current state of the law of Ukraine on the use of attorney’s robe. While
practicing law, an attorney shall have the right to perform any actions that are not prohibited by law, by the professional conduct rules and by the agreement on the provision of legal services and that are necessary for the proper performance of the agreement on provision of legal services. The use of attorney’s robe is the tradition of the bar in the world. However, the use of attorney’s robe is not provided by the
Law On the Bar and Practice of Law and the professional conduct rules of attorney in Ukraine. The author draws up proposals for the article 20 of the Law On the Bar and Practice of Law shall be amended to professional right of attorney to use of attorney’s robe in criminal, civil, commercial, administrative and constitutional courts, where the attorney provides legal defense, representation and protection rights,
freedoms and interests of individuals, rights and interests of legal entities. The author offers that a sample attorney’s robe shall be approved by the Bar Council of Ukraine. The Bar Council of Ukraine functions of attorneys’ self-government during the period between the congresses of attorneys of Ukraine in accordance with the article 55 of the Law On the Bar and Practice of Law and decisions of the congress of attorneys of Ukraine. The attorneys’ self-governance – the right of attorneys guaranteed by the state to independently resolve the issues of the organization and operation of the bar of Ukraine per the procedure provided for by this Law. So it is necessary to set these powers of the Bar Council of Ukraine in the article 55 of the Law On the Bar and Practice of Law and in the statutory document of the Bar Council
of Ukraine.
